You may see or hear the term ‘Living Wills’. ‘Living Wills’ are documents about wishes and preferences, often made before the implementation of the Mental Capacity Act 2005.
They are unlikely to meet the legal requirements of the Mental Capacity Act 2005, so it is advisable to update any ‘Living Wills’ documents to an Advance Decision to Refuse Treatment document , which meets the Mental Capacity Act requirements– please see Advance Decision to Refuse Treatment for further information.
